The personal data collected by our company and listed above is processed in accordance with the fundamental principles set forth by the Personal Data Protection Law (KVKK) and within the scope of the conditions and purposes for processing personal data specified in Articles 5 and 6 of the KVKK, for the following purposes:

4.To Whom and For What Purposes Personal Data May Be Disclosed

Your personal data collected will be processed in accordance with the fundamental principles set forth by the Law and the conditions and purposes for processing personal data specified in Articles 8 and 9 of the Law, IKEA may transfer the photos you share for publication and for the purposes outlined in this Information Notice to content management service providers, hosting and cloud service providers, IKEA affiliates, and, in the event of cloud system usage, to our group companies abroad, social media platforms, legally authorized public institutions, and authorized private entities.

5.Method of Collection and Legal Basis for Personal Data

The personal data collected as part of this process is collected electronically via the photo upload tool available on our website. Your personal data is collected based on your explicit consent pursuant to Article 5/1 of the Law, provided that your explicit consent is obtained; pursuant to Article 5/2(c) of the Law, provided that the processing of personal data belonging to the parties to a contract is necessary for the establishment or performance of the contract; and pursuant to Article 5/2(d) of the Law, provided that the data has been made public by the data subject themselves. The personal data collected from you may be processed and transferred for the purposes specified in this Privacy Notice, in accordance with the conditions and purposes of personal data processing set forth in Articles 5 and 6 of the Law.

6.Your Rights Regarding Your Personal Data

To exercise your rights as a data subject under Article 11 of the Personal Data Protection Law regarding the processing of the personal data you provide to us through the methods outlined above, in accordance with the “Communication on the Procedures and Principles for Applications to the Data Controller”;

Subject to our obligations arising from applicable laws and regulations, we commit to ensuring that you may exercise these rights at any time and in the most appropriate manner. For this purpose, you may contact us using the contact information provided in paragraph 1.

1.SCOPE AND ACKNOWLEDGEMENT

By accepting these Terms and uploading content ("Content") the user ("User"), declares and undertakes that they have read, understood, and accepted the provisions below.

2. TRANSFER OF COPYRIGHT AND LICENSING

2.1. The User transfers to IKEA all economic rights in the Content uploaded by the User (including the rights of reproduction, distribution, adaptation, public performance, and the right to communicate to the public via any means capable of transmitting sound and/or images) in the form of a perpetual, fully transferable, and sublicensable license, without any geographical or medium restrictions.

2.2. The User grants IKEA permission to exercise their moral rights in the Content (including the right to object to modifications and the right to public disclosure) and expressly acknowledges and accepts IKEA’s authority to use, modify, crop, edit, and combine the Content with other content across any medium (website, mobile app, social media, advertisements, promotional materials, etc.).

2.3. IKEA has the right to request a written consent form from the User regarding the transfer of intellectual property rights to the works, provided that the scope of the transfer is not expanded, and the User agrees to submit the signed written undertaking to IKEA within 15 (fifteen) days of receiving such a request.

3. CONTENT RULES AND RESTRICTIONS

3.1. The User warrants that the Content uploaded by them:
a) Is entirely created by them and is original,
b) Does not infringe upon third parties’ copyrights, trademark rights, personality rights, intellectual property rights, or other rights,
c) Was not generated using artificial intelligence tools and is not fake,
d) Is not defamatory toward IKEA or third parties,
e) Does not violate applicable laws (e.g., obscene, violent, hate speech, discriminatory, insulting, etc.),
f) It does not contain political propaganda, ideological messages, or promotion of political parties or individuals,
g) It does not contain photographs of individuals,
h) It does not contain elements constituting works of art (such as third parties’ artistic works, photographs, designs, etc.),
i) It does not contain misleading, deceptive, or false information,
the User hereby declares, undertakes, and guarantees.

3.2. If the Content includes photographs of individuals, elements constituting works of art, or any other elements subject to third-party rights in violation of the above rules, the User undertakes that they have obtained all necessary permissions from such individuals, provided the required disclosure in accordance with the Personal Data Protection Law (KVKK), and secured their explicit consent where necessary.

4. CONTRIBUTIONS BY THIRD PARTIES

4.1. If others have contributed to the creation of the Content, the User undertakes that such persons have also accepted these Terms and that the User has obtained all necessary permissions from them.

4.2. Upon IKEA’s request, the User is obligated to immediately notify IKEA in writing of all third parties who contributed to the creation of the Content (including their names and contact information).

5. IKEA’S RIGHTS AND AUTHORITIES

5.1. IKEA may reject, remove, edit, or refrain from using any Content without providing any justification

5.2. IKEA may remove Content from Users who violate these Terms and may prevent them from sharing Content in the future.

5.3. IKEA is under no obligation to publish Content on its website or mobile app.

6. LIABILITY AND INDEMNIFICATION

6.1. The User agrees and undertakes to immediately and in full indemnify IKEA for any and all damages, losses, indemnities, penalties, court costs, and attorney’s fees incurred by IKEA as a result of the sharing or use of Content or a breach of these Terms.

6.2. Any claims, lawsuits, or demands for infringement of rights brought against IKEA by third parties due to the Content are the sole responsibility of the User.

7. GENERAL PROVISIONS

7.1. These Terms are governed by the laws of the Republic of Turkey.

7.2. The courts and enforcement offices of Istanbul (Çağlayan) shall have jurisdiction over any disputes arising from these Terms.

7.3. IKEA reserves the right to unilaterally amend these Terms at any time.
